Comments (i) Multiplexing software: The use of one or more external tools, including multiplexers or replicators, to reduce the number of users directly linked to the licensed software, does not exempt the licensee from the purchase of licenses for all users. For example, the use of multiplexing or login software or hardware to reduce the number of users directly connected to the licensed software, the number of designated users or concomitant users within the licensee`s organization using licensed software is measured as the number of different entries for multiplexing or front-end pooling, and the licensee must purchase the corresponding number of licensees. If the licensee uses synthesizer software, the licensee cannot use the software licensed or share licenses in a manner that is not expressly provided for in this license agreement. (ii) API: Any user of a third-party application who accesses programming interfaces for licensed software applications (product API) must have a valid license to connect to the licensed software. The licensee must not and should not allow others to re-edit, decompilate or decompile product APIs. Commercial sales of products containing product APIs require a separate distribution license and this licence is not granted by this license agreement. (iii) TeamInspector: TeamInspector is only allowed on the basis of a designated user. (iv) Connectors: A license purchased for this licensed software allows the use of this software in any quantity exclusively in association with TeamAnalytics, which is authorized and ordered separately. A “virtual machine,” a software implementation that runs programs like a physical computer, in which the software that is run inside the virtual machine is limited to the resources and abstractions provided by the virtual machine. SILK PERFORM. This licensed software can be installed on a reasonable number of licensed computer systems. The licensee may use the Multi-Machine Controller component (also known as “Workbench”) and associated load test agents on an unlimited number of computers for an unlimited number of users, but only in combination with the use of SilkPerformer based on the number, type and class of Virtual User Licenses purchased.

Premium Virtual User Licenses for SilkPerformer, if ordered in any quantity, contain a single limited license for designated users to use SilkTest (the “additional product”). The additional product should not be used in combination with SilkPerformer`s Premium Virtual User Licenses and should not be used or transmitted autonomously. The incremental use of an additional product beyond the individual license for designated users or stand-alone use must be granted and paid separately. a unique processing unit within a computer chip, consisting of a unit of arithmetic logic, registers, ordering and fetish/memory. “CPU” (Central Processing Unit) refers to an information processing unit normally identified using a single chip, mounted on a single circuit board and capable of several nuclei. A computer “box” can hold multiple processors. The “box” is sometimes called a “server” or “machine” (or perhaps “mainframe”). This licensed software may contain certain files, libraries and/or source code, which are expressly referred to as “redistributable” by the licensee in the accompanying print or online documentation and are required to use works created with the product (“Redistributable”). From time to time, the licensee may designate other files as redistributable. Subject to the terms of this licensee, the licensee may freely redistribute the source code or compiled code that is wholly owns the licensee and does not contain redistributables.

Subject to the conditions of this licensing agreement, the donor grants the licensee the personal licensee, not exclusive, non-transferable
