An organization is considered to be the operator of a university linked to a university only if there is a formal membership agreement stipulating that the parent organization (the university) agrees to grant diplomas to graduates of the affiliated college in exchange for some control over academic standards and courses it offers to the affiliated college. A vocational school offers 4 self-contained courses on floral design. An individual can take one or all courses. The courses are taught on the basis of a passport/certificate after the completion of each course. However, the different courses do not qualify as a program and are not taught by the school as part of a program. As a structure, a single course would not lead to sufficient learning progress to certify the competence of individuals to practice or practice a profession or vocation. Accordingly, the certificate issued after the completion of each course cannot attest to the competence of individuals to practise or practice a profession or to exercise a vocation, and delivery is not exempt in accordance with Part III, Section 8, of Appendix V. If the circumstances are taken into account in the interpretation of the terms of the contract, they must never overburden the terms of this agreement (Hayes Forest Services, paragraph 14; and Hall, p. 30).
