This HIPAA Counterparty Agreement (“BAA”) is entered into by and between MH Sub I, LLC (“Business Partners”) and you (“Healthcare Providers”) who have entered into a service agreement with business partners for the purpose of complying with the Health Insurance Portability and Accountability Act and its Administrative Simplification Rules (“45 CFR 160-164”) (“HIPAAA”), subtitle D of the Health Information Technology for Economic and Clinical Health Act (“HITECH”), Chlossen. and the 2013 omnibus rule (“omnibus rule”). This BAA is amended and is included in any underlying agreement between healthcare providers and counterparties; To the extent that the provisions of this BAA are contrary to those of an underlying agreement, priority shall be given to the provisions of this BAA.
